Organization: Release: Law Society of Upper Canada
TORONTO, Feb. 12 /CNW/ – The Treasurer of the Law Society of Upper
Canada, Gavin MacKenzie, today expressed the Law Society’s continuing concern over the need
for a well-funded and sustainable system of legal aid
in Ontario.
“We believe that the right of vulnerable citizens to legal assistance is an important
component of the administration of justice in a free and democratic society,” the Treasurer said.
“Since the Ontario Legal Aid Plan was founded in 1967, the Law Society has recognized that legal aid should be considered a right, not a charitable gift,
and that individuals
are equal before the law
only
if they are assured the option of legal representation.”
Since 1982 it was guaranteed to every individual and the taxpayers pay enough not to consider it a charity or anything else but a possession, personal property attached as an arm or a leg to the certainty every individual is protected from the criminal element that obviously the governments are the ultimate criminal element.
“More than a million Ontarians benefit from Legal Aid Ontario every year, many of them through our excellent clinic system”, he added. “Legal aid also helps many vulnerable Ontarians with family law, criminal law, workers’ compensation, immigration, landlord-tenant and other legal issues.” But there are still many thousands of individuals in Ontario who cannot afford legal services and do not qualify for support from the system. The income threshold is far too low – if you earn just over $13,000 a year you are too rich to qualify for legal aid. We are alarmed by the dramatic increase in the number of people who try to represent themselves in court without the benefit of legal representation or advice about their rights.
Others simply give up their right to a fair hearing.
For all of these people, access to justice is denied.“
What Ontario lawyers perceived in the 1920s, what the Joint Committee expressed in the
1960s, and what many people experience first-hand in Ontario courts every day, is that
individuals are equal before the law only if they are
assured
the option of representation by counsel.
In a democratic society,everyone should be able to participate fully in
society and
have their rights protected.
Canada has an adversarial justice system that anticipates two roughly equal parties
presenting their cases before a judge in a court of law.
What happens if there is an imbalance of power between the two parties?
When an Ontarian cannot afford to hire a lawyer,
an
imbalance of power exists,
especially
when the state is one of the parties,
as in criminal law and child protection cases. Legal aid attempts to correct this imbalance by providing low-income individuals with legal representation.
The legal aid system contributes
to ensuring
the potential
for equal protection and benefit of
the law for the poor and disadvantaged in our society.
- (1) Anyone whose rights or freedoms, as guaranteed by this Charter,
have been infringed or denied
may apply to a court of competent jurisdiction

- An employee or a volunteer representative of a trade union who is acting on behalf of the union or a member of the union in connection with a grievance, a labour negotiation, an arbitration proceeding or a proceeding before an administrative tribunal.
- A person or a member of a class of persons prescribed by the by-laws, in the circumstances prescribed by the by-laws. 2006, c. 21, Sched. C, s. 2 (10).
An important part of the Crown’s – and thus the Attorney General’s – responsibility
in conducting criminal prosecutions
is
associated with the responsibility to represent the public interest
– which includes not only
the community as a whole
and
the victim,
but
also the accused.

The Attorney General has a unique role to play as a Minister.
One part of the Attorney General’s role is that of a Cabinet Minister. In this capacity the Minister is responsible for representing the interests and perspectives of the Ministry at Cabinet, while simultaneously representing the interests and perspectives of Cabinet and consequently the Government to the Ministry and the Ministry’s communities of interest.
The Attorney General is the chief law officer of the Executive Council. The responsibilities stemming from this role are unlike those of any other Cabinet member. The role has been referred to as “judicial-like” and as the “guardian of the public interest”.
Much has been written on the subject of ministerial responsibilities and the unique role of the Attorney General.
There are various components of the Attorney General’s role. The Attorney General has unique responsibilities to the Crown, the courts, the Legislature and the executive branch of government. While there are different emphases and nuances attached to these there is a general theme throughout all the various aspects of the Attorney General’s responsibilities that the office has a constitutional and traditional responsibility beyond that of a political minister.
The statutory responsibilities of the office are found in section 5 of the Ministry of the Attorney General Act. Section 5 states:
The Attorney General,
(a) is the Law Officer of the Executive Council;
(b) shall see that the administration of public affairs is in accordance with the law;
(c) shall superintend all matters connected with the administration of justice in Ontario;
(d) shall perform the duties and have the powers that belong to the Attorney General and Solicitor General of England by law and usage, so far as those powers and duties are applicable to Ontario, and also shall perform the duties and powers that, until the Constitution Act, 1867 came into effect, belonged to the offices of the Attorney General and Solicitor General in the provinces of Canada and Upper Canada and which, under the provisions of that Act, are within the scope of the powers of the Legislature;
(e) shall advise the Government upon all matters of law connected with legislative enactments and upon all matters of law referred to him or her by the Government;
(f) shall advise the Government upon all matters of a legislative nature and superintend all Government measures of a legislative nature;
(g) shall advise the heads of ministries and agencies of Government upon all matters of law connected with such ministries and agency;
(h) shall conduct and regulate all litigation for and against the Crown or any ministry or agency of government in respect of any subject within the authority or jurisdiction of the Legislature;
(i) shall superintend all matters connected with judicial offices;
(j) shall perform such other functions as are assigned to him or her by the Legislature or by the Lieutenant Governor in Council. “What follows is an overview of the various components of the Attorney General’s roles and responsibilities, primarily as outlined in the Act.
Chief Law Officer of the Executive Council (s. 5(a))
The role of chief law officer might be referred to as the Attorney General’s overall responsibility as the independent legal advisor to the Cabinet – and some have even suggested that the role possibly extends to the Legislature as well. The importance of the independence of the role is fundamental to the position and well established in common law, statutes and tradition.
As chief law officer, the Attorney General has a special responsibility to be the guardian of that most elusive concept – the rule of law. The rule of law is a well established legal principle, but hard to easily define. It is the rule of law that protects individuals, and society as a whole, from arbitrary measures and safeguards personal liberties.
The Attorney General has a special role to play in advising Cabinet to ensure the rule of law is maintained and that Cabinet actions are legally and constitutionally valid.
In providing such advice it is important to keep in mind the distinction between the Attorney General’s policy advice and preference and the legal advice being presented to Cabinet. The Attorney General’s legal advice or constitutional advice should not be lightly disregarded. The Attorney General’s policy advice has the same weight as that of other ministers.
Criminal prosecutions (s.5(d))
One of the most publicly scrutinized aspects of the Attorney General’s role is the responsibility for criminal prosecutions encompassed in section 5 (d) and s. 92 of the Constitution Act, 1867. Section 92 gives the provinces authority to legislate in matters related to the administration of criminal justice and thereby gives the provincial Attorney General authority to prosecute offences under the Criminal Code.
The Attorney General does not, however, direct or cause charges to be laid. While the Attorney General and the Attorney General’s agents may provide legal advice to the police, the ultimate decision whether or not to lay charges is for the police. Once the charge is laid the decision as to whether the prosecution should proceed, and in what manner, is for the Attorney General and the Crown Attorney.
It is now an accepted and important constitutional principle that the Attorney General must carry out the Minister’s criminal prosecution responsibilities independent of Cabinet and of any partisan political pressures. The Attorney General’s responsibility for individual criminal prosecutions must be undertaken – and seen to be undertaken – on strictly objective and legal criteria, free of any political considerations. Whether to initiate or stay a criminal proceeding is not an issue of government policy. This responsibility has been characterized as a matter of the Attorney General acting as the Queen’s Attorney – not as a Minister of the government of the day.
This is not to suggest that decisions regarding criminal prosecutions are made in a complete vacuum. A wide range of policy considerations may be weighed in executing this responsibility, and the Attorney General may choose to consult the Cabinet on some of these considerations. However any decisions relating to the conduct of individual prosecutions must be the Attorney General’s alone and independent of the traditional Cabinet decision making process. In practice, in the vast majority of cases, these decisions are made by the Attorney General’s agents, the Crown Attorneys.

Although the Attorney general can become involved in decision-making in relation to individual criminal cases, such a practice would leave the Minister vulnerable to accusations of political interference. Accordingly, it is traditional to leave the day-to-day decision-making in the hands of the Attorney General’s agents, the Crown Attorneys, except in cases of exceptional importance where the public would expect the Attorney General to be briefed.
Legislative Responsibilities (s. 5(e) and (f))
The Attorney General has broad responsibilities associated with Government legislation. These responsibilities have been described as twofold. One is to oversee that all legislative enactments are in accordance with principles of natural justice and civil rights (see also s. 5(b) above). This is obviously an important and broad area of responsibility. The second aspect of this responsibility is to advise on the constitutionality and legality of legislation.
The Attorney General’s legislative responsibilities are played out in a variety roles. The Office of Legislative Counsel reports to the Attorney General. Legislative Counsel plays a key role in ensuring the legal integrity of Government legislation. Although the Legislative Counsel’s reporting relationship to the Attorney General does allow the Attorney General to provide guidance and set standards, individual pieces of legislation are drafted on instructions from client ministries and are not within the sole control of Legislative Counsel or the Attorney General. It should also be noted that Legislative Counsel also has a direct responsibility to the Legislature as the Office also drafts all private member’s bills.
The Attorney General has a further role to play as part of whatever Cabinet Committee is formed to review legislation and regulations. Here the Minister has an opportunity to comment on the technical issues related to legislation and regulations prior to Cabinet consideration.
The Attorney General’s role on legislative matters is as an adviser to the Cabinet. Although unlikely, Cabinet could, in theory, receive the Attorney General’s legal opinion on legislation and choose to disregard it. The Attorney General’s role is not independent of Cabinet decision making as in the area of criminal prosecutions. As was noted earlier, the Attorney General must make careful distinctions about the legal opinions and policy or political preferences being offered about legislation.
Civil Litigation (s.5(h) and (d))
In addition to the specific responsibilities to conduct civil litigation on behalf of the Government and its agencies (s. 5(h)), the Attorney General has broader litigation responsibilities flowing from the historical powers of the Attorney General referred to in s. 5(d) of the Act. These powers are based on the Crown’s parens patriae (parental) authority. The Attorney General’s authority, therefore, is not only to conduct litigation in cases directly affecting the government or its agencies but also to litigate cases where there is a clear matter of public interest or public rights at stake.
This has been characterized as a constitutional responsibility to ensure that the public interest is well and independently represented. It may involve interventions in private litigation or Charter challenges to legislation, even if the arguments conclude that the legislation does contravene constitutionally protected rights.
Responsibility for Court Administration (s. 5(c))
A key component of the Attorney General’s responsibilities to ensure the administration of justice in the province is the administration of the courts and as a result the responsibility for maintaining liaison with the judiciary.
Given the fundamental importance of the independence of the judiciary, the responsibility for courts administration is often a very sensitive and delicate issue. Great care and respect for the principles of judicial independence must be exercised in this area.

Transcendental Idealism
Transcendental idealism is a doctrine founded by German philosopher Immanuel Kant in the 18th century. Kant’s doctrine maintains that human experience of things is similar to the way they appear to us—implying a fundamentally subject-based component, rather than being an activity that directly (and therefore without any obvious causal link) comprehends the things as they are in themselves.

Although it influenced the course of subsequent German philosophy dramatically, exactly how to interpret this concept was a subject of some debate among 20th century philosophers. Kant first describes it in his Critique of Pure Reason, and distinguished his view from contemporary views of realism and idealism, but philosophers do not agree how sharply Kant differs from each of these positions.
Transcendental idealism is associated with formalistic idealism on the basis of passages from Kant’s Prolegomena to any Future Metaphysics, although recent research has tended to dispute this identification. Transcendental idealism was also adopted as a label by the subsequent German philosophers Fichte and Schelling, Schopenhauer, and in the early 20th century by Husserl in the novel form of transcendental-phenomenological idealism.
Kant[edit]
Perhaps the best way to approach transcendental idealism is by looking at Kant’s account of how we intuit (German: anschauen) objects, and that task demands looking at his accounts of space and of time. Before Kant, some thinkers, such as Leibniz, had come to the conclusion that space and time were not things, but only the relations among things. Other thinkers, including Newton, maintained that space and time were real things or substances. Leibniz had arrived at a radically different understanding of the universe and the things found in it. According to his Monadology, all things that humans ordinarily understand as interactions between and relations among individuals (such as their relative positions in space and time) have their being in the mind of God but not in the Universe where we perceive them to be. In the view of realists, individual things interact by physical connection and the relations among things are mediated by physical processes that connect them to human brains and give humans a determinate chain of action to them and correct knowledge of them. Kant was aware of problems with both of these positions. He had been influenced by the physics of Newton and understood that there is a physical chain of interactions between things perceived and the one who perceives them. However, an important function of mind is to structure incoming data and to process it in ways that make it other than a simple mapping of outside data.[1]
If we try to keep within the framework of what can be proved by the Kantian argument, we can say that it is possible to demonstrate the empirical reality of space and time, that is to say, the objective validity of all spatial and temporal properties in mathematics and physics. But this empirical reality involves transcendental ideality; space and time are forms of human intuition, and they can only be proved valid for things as they appear to us and not for things as they are in themselves.[2]
The salient element here is that space and time, rather than being real things-in-themselves or empirically mediated appearances (German: Erscheinungen), are the very forms of intuition (German: Anschauung) by which we must perceive objects. They are hence neither to be considered properties that we may attribute to objects in perceiving them, nor substantial entities of themselves. They are in that sense subjective, yet necessary, preconditions of any given object insofar as this object is an appearance and not a thing-in-itself. Humans necessarily perceive objects as located in space and in time. This condition of experience is part of what it means for a human to cognize an object, to perceive and understand it as something both spatial and temporal: “By transcendental idealism I mean the doctrine that appearances are to be regarded as being, one and all, representations only, not things in themselves, and that time and space are therefore only sensible forms of our intuition…”[3] Kant argues for these several claims in the section of the Critique of Pure Reason entitled the “Transcendental Aesthetic”. That section is devoted to inquiry into the a priori conditions of human sensibility, i.e. the faculty by which humans intuit objects. The following section, the “Transcendental Logic”, concerns itself with the manner in which objects are thought.
Historical parallels[edit]
Xenophanes of Colophon in 530 BC anticipated Kant’s epistemology in his reflections on certainty. “And as for certain truth, no man has seen it, nor will there ever be a man who knows about the gods and about all the things I mention. For if he succeeds to the full in saying what is completely true, he himself is nevertheless unaware of it; and Opinion (seeming) is fixed by fate upon all things.”[4] Certain interpretations of some of the medieval Buddhists of India, such as Dharmakirti, may reveal them to be transcendental idealists, since they seemed to hold the position of mereological nihilism but transcendental idealists who held that their minds were distinct from the atoms. Some Buddhists often attempt to maintain that the minds are equal to the atoms of mereological nihilist reality, but Buddhists seem to have no explanation of how this is the case, and much of the literature on the aforementioned Buddhists involves straightforward discussion of atoms and minds as if they are separate. This makes their position very similar to transcendental idealism, resembling Kant’s philosophy where there are only things-in-themselves (which are very much like philosophical atoms), and phenomenal properties.
Schopenhauer[edit]
Briefly, Schopenhauer described transcendental idealism as a “distinction between the phenomenon and the thing in itself”, and a recognition that only the phenomenon is accessible to us because “we know neither ourselves nor things as they are in themselves, but merely as they appear.”[5] Some of Schopenhauer’s comments on the definition of the word “transcendental” are as follows:
Transcendental is the philosophy that makes us aware of the fact that the first and essential laws of this world that are presented to us are rooted in our brain and are therefore known a priori. It is called transcendental because it goes beyond the whole given phantasmagoria to the origin thereof. Therefore, as I have said, only the Critique of Pure Reason and generally the critical (that is to say, Kantian) philosophy are transcendental.

Schopenhauer contrasted Kant’s transcendental critical philosophy with Leibniz’s dogmatic philosophy.
With Kant the critical philosophy appeared as the opponent of this entire method [of dogmatic philosophy]. It makes its problem just those eternal truths (principle of contradiction, principle of sufficient reason) that serve as the foundation of every such dogmatic structure, investigates their origin, and then finds this to be in man’s head. Here they spring from the forms properly belonging to it, which it carries in itself for the purpose of perceiving and apprehending the objective world. Thus here in the brain is the quarry furnishing the material for that proud, dogmatic structure. Now because the critical philosophy, in order to reach this result, had to go beyond the eternal truths, on which all the previous dogmatism was based, so as to make these truths themselves the subject of investigation, it became transcendental philosophy. From this it follows also that the objective world as we know it does not belong to the true being of things-in-themselves, but is its mere phenomenon, conditioned by those very forms that lie a priori in the human intellect (i.e., the brain); hence the world cannot contain anything but phenomena.

P. F. Strawson[edit]
In The Bounds of Sense, P. F. Strawson suggests a reading of Kant’s first Critique that, once accepted, forces rejection of most of the original arguments, including transcendental idealism. Strawson contends that, if Kant had followed out the implications of all that he said, he would have seen that there were many self-contradictions implicit in the whole.
Strawson views the analytic argument of the transcendental deduction as the most valuable idea in the text, and regards transcendental idealism as an unavoidable error in Kant’s greatly productive system. In Strawson’s traditional reading (also favored in the work of Paul Guyer and Rae Langton), the Kantian term phenomena (literally something that can be seen from the Greek word phainomenon, “observable”) refers to the world of appearances, or the world of “things” sensed. They are tagged as “phenomena” to remind the reader that humans confuse these derivative appearances with whatever may be the forever unavailable “things in themselves” behind our perceptions. The necessary preconditions of experience, the components that humans bring to their apprehending of the world, the forms of perception such as space and time, are what make a priori judgments possible, but all of this process of comprehending what lies fundamental to human experience fails to bring anyone beyond the inherent limits of human sensibility. Kant’s system requires the existence of noumena to prevent a rejection of external reality altogether, and it is this concept (senseless objects of which we can have no real understanding) to which Strawson objects in his book.
Henry A. Allison[edit]
In Kant’s Transcendental Idealism, Henry A. Allison proposes a reading that opposes Strawson’s interpretation.[6] Allison argues that Strawson and others misrepresent Kant by emphasising what has become known as the two-worlds reading (a view developed by Paul Guyer). This—according to Allison, false—reading of Kant’s phenomena/noumena distinction suggests that phenomena and noumena are ontologically distinct from each other. It concludes on that basis that we somehow fall short of knowing the noumena due to the nature of the very means by which we comprehend them. On such a reading, Kant would himself commit the very fallacies he attributes to the transcendental realists. On Allison’s reading, Kant’s view is better characterized as a two-aspect theory, where noumena and phenomena refer to complementary ways of considering an object. It is the dialectic character of knowing, rather than epistemological insufficiency, that Kant wanted most to assert.
Opposing realism[edit]
Opposing Kantian transcendental idealism is the doctrine of philosophical realism, that is, the proposition that the world is knowable as it really is, without any consideration of the knower’s manner of knowing. This has been propounded by philosophers such as Bertrand Russell, G. E. Moore, Ralph Barton Perry, and Henry Babcock Veatch. Realism claims, contrary to idealism, that perceived objects exist in the way that they appear, in and of themselves, independent of a knowing spectator’s mind.

The request for God’s kingdom to come is usually interpreted as a reference to the belief, common at the time, that a Messiah figure would bring about a Kingdom of God.
Traditionally the coming of God’s Kingdom is seen as a divine gift to be prayed for,
not a human achievement.
This idea is frequently challenged by groups who believe that the Kingdom will come by the hands of those faithful to work for a better world. It is believed by these individuals that Jesus’ commands to feed the hungry and clothe the needy are the Kingdom to which he was referring.

The Catechism of the Catholic Church (CCC)
teaches that the coming
Reign of God
will be a kingdom of love, peace, and justice.[23]

the ultimate triumph of Christ’s Kingdom will not come about until Christ’s return to earth at the end of time.[31]
During Christ’s second coming, he will judge the living and the dead.
Only those who are judged to be righteous and just will reign with Christ forever.[32]
Christ’s second coming will also mark the absolute defeat of all evil powers, including Satan.[33]
Until then,
the coming of the Kingdom will continue to be attacked by evil powers
as Christians wait with hope
for the second coming of their Savior.[34]
